Terms of Service
These Terms of Service constitute a legally binding agreement between you and IBackTested regarding your access to and use of the IBackTested quantitative infrastructure platform, simulation suites, and associated analytical services.
1. Acceptance of Terms & Scope of Services
By creating an account, accessing, or using the IBackTested website, APIs, or analytical engines (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a legal entity, including a proprietary trading firm, hedge fund, asset management desk, or family office, you represent that you have the authority to bind such entity.
The Platform encompasses vector backtesting engines, strategy compilation copilots, Monte Carlo stress-testing suites, real-time forward test executors, historical tick databases, and financial modeling tools (e.g., DCF, Comps, Broker Trust Scanners).
2. Mathematical Simulation & No Investment Advice
IBackTested is a technology infrastructure and mathematical simulation provider. IBackTested is NOT an investment advisor, registered broker-dealer, commodity trading advisor (CTA), or custodian.
All analytics, metrics (including Sharpe ratios, Calmar ratios, maximum drawdowns, and Kelly fractions), and AI-assisted strategy code generated on the Platform are for educational, research, and self-directed hypothesis validation purposes only.
Simulated results have inherent technical limitations. Hypothetical trading does not involve financial risk, emotional drag, liquidity voids, or order rejection delays experienced in actual live market conditions. Past simulated performance does not guarantee future financial returns.
3. Strategy Ownership & Alpha Confidentiality Guarantee
You retain full, exclusive, and unencumbered intellectual property ownership over all trading algorithms, rule combinations, parameters, indicators, and proprietary strategies you create, import, compile, or backtest on IBackTested.
IBackTested guarantees that:
- Your trading strategies and backtest telemetry are isolated in encrypted database rows with tenant-level access controls.
- IBackTested does NOT front-run, copy-trade, monetize, share, or pool user alpha with any third party, proprietary trading desk, or external fund.
- You have the permanent right to export your complete strategy code, backtest logs, and historical performance tables in standard open formats (JSON, CSV, Parquet) at any time.
4. Service Access, Compute Quotas & Future Paid Plans
During the current phase, access to the Platform — including the Strategy Wizard, vector backtest engine, simulation environments, and research labs — is provided free of charge, subject to the fair-use compute quotas and rate limits described on the Platform and enforced to protect service stability for all users.
IBackTested may introduce optional paid plans, tiers, or add-ons in the future. If and when paid offerings become available, the applicable pricing, features, billing cycle, renewal terms, cancellation process, and refund terms will be presented clearly at the point of purchase and summarized in these Terms and in our Refund & Cancellation Policy before any charge occurs. No payment information is required for the current free access, and you will never be charged without explicitly completing a purchase flow.
Export Controls & Trade Sanctions
The Platform is subject to United States export-control laws and regulations. By accessing or using IBackTested, you represent and warrant that:
- You are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive U.S. trade sanctions (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions), and you are not listed on any U.S. government restricted-party list such as the OFAC Specially Designated Nationals List.
- You will not use the Platform for any purpose prohibited by applicable export-control or sanctions laws.
- You are responsible for compliance with the laws of your own jurisdiction regarding the use of trading-analytics software.
Access to the Platform from sanctioned jurisdictions is blocked, and accounts found to violate these restrictions may be suspended without refund where required by law.
5. Market Feeds, Execution Drag & Latency Realities
Market candle data is aggregated from premier institutional liquidity hubs, global multi-asset exchanges, and Tier-1 interbank datafeeds. While IBackTested maintains high-speed columnar Parquet caching and sub-millisecond local indexing, network delivery and historical feed consistency are provided on an "as-is" basis.
Our simulation engines incorporate customizable market friction models (commissions, spread expansion, slippage, and overnight swap drag). You acknowledge that simulated execution results represent estimates of execution friction and cannot perfectly replicate fragmented order-book dynamics.
6. Prohibited Activities & System Integrity
You agree not to engage in any of the following prohibited actions:
- Reverse-engineering, decompiling, or extracting proprietary source code from the IBackTested vector backtest engine or ablation algorithms.
- Employing automated scrapers, flood bots, or distributed denial-of-service payloads against Platform endpoints.
- Sharing single-seat user login credentials or API keys with unauthorized third parties.
- Representing hypothetical IBackTested backtest reports as verified live financial returns to solicit retail investor capital in violation of regulatory statutes.
7. Limitation of Liability & Indemnity
To the maximum extent permitted by applicable law, IBackTested, its officers, developers, and licensors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from:
- Financial trading losses incurred on live brokerage accounts from strategies developed or evaluated on the Platform.
- Temporary market data pipeline interruptions, feed outages, or server maintenance windows.
- Discrepancies between simulated backtest executions and live broker fills.
8. Governing Law, Venue & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through binding confidential arbitration administered by the American Arbitration Association (AAA).
